Confidential Information in Court Records

Do you believe that a court record held by the Hillsborough County Clerk of Court contains confidential information that should not be publicly viewable? Detailed information regarding what may be considered confidential in a court record can be located in  Florida Rules of General Practice and Judicial Administration 2.420 and 2.423. A Notice of Confidential Information or Notice of Confidential Crime Victim Information within Court Filing should be filed separately in each case if multiple cases contain confidential information. An address can only be made confidential by filing a  REQUEST FOR CONFIDENTIAL FILING OF ADDRESS.

If a document or other information submitted to a court record does not fall under any provisions under the  Florida Rules of General Practice and Judicial Administration 2.420 or 2.423 and you believe this information should be made confidential, you may file a Motion to Determine Confidentiality of Court Records (the Clerk does not provide the Motion to Determine Confidentiality of Court Records form; you can consult with your legal advisor or research it at a public law library).

Only those medical records specifically outlined under  Florida Rules of General Practice and Judicial Administration 2.420 [external website link] will be maintained as confidential upon the filing of a Notice of Confidential Information. All other medical records will only be maintained as confidential upon motion and order of the Court.

If an entire court record is maintained as confidential, documents added to that record do not require the notice form.

Once this form has been completed, it may be submitted to the case by e-filing, mailed to PO Box 3360, Tampa, FL 33601-3360, or dropped off in person at our Tampa or Plant City customer service center locations. Emailing or faxing this form is not permitted.
