Expungement and Sealing

Welcome to the Expungement and Sealing Unit (ESU) of the Hillsborough County Clerk of the Circuit Court.  This following information is provided to assist you with going through the process of requesting the sealing or expungement of your criminal history record(s).  If you have questions or concerns about these forms, instructions, or your legal rights, it is strongly recommended that you consult with an attorney.  If you do not know an attorney, you may contact the Hillsborough County Bar Association Legal Referral Service.Based upon the 1995 Florida Attorney General Opinion, the Office of the Public Defender for the Thirteenth Judicial Circuit may not represent an indigent individual in a proceeding to expunge or seal a criminal record, regardless of whether or not the office has been previously appointed to represent the individual in a criminal matter. 

There are multiple steps which you must go through in order to obtain a court order to seal or expunge your criminal history records, the first of which is obtaining a Certificate of Eligibility from the Florida Department of Law Enforcement.   This site is very informative and provides you with downloadable forms.  A certified copy of the disposition of the charge(s) to which the petition to seal/expunge pertains must be submitted.   For more information in regards to obtaining certified copies of a disposition click on the applicable court type:  Misdemeanor / Felony / TrafficJuvenile.

Upon obtaining your Certificate of Eligibility, return to this website and complete the Petition to Seal/Expunge, Affidavit, and applicable Order below.   It is important to note that pursuant to Florida Statutes and local Administrative Order (Administrative Order 2008-146) that all costs, fines, and fees must be paid in full prior to your petition being considered by the court.  Contact the ESU of the Clerk of the Circuit Court at (813) 276-2029, extension 3800 to request a detailed listing of the costs, fines, and fees which must be paid.  The ESU will review your file and determine the costs associated with the sealing or expunging of your record.

You may request Expungement and Sealing forms through our office.  The information necessary for completing these forms can be located on the Certificate of Eligibility which you obtained from the Florida Department of Law Enforcement.  Please note that the format of these forms is taken directly from the Florida Rules of Criminal Procedure.  These forms are provided as a convenience and you may find that you need to adjust the forms to fit your situation.

After you have obtained your Certificate of Eligibility and have completed the above forms, please submit them to the ESU of the Clerk of the Circuit Court along with all monies due.  Please note that PERSONAL CHECKS WILL NOT be accepted for payment of these fees. 

For Felony, Misdmeanor, and Traffic cases you should deliver your paperwork and payment in person to the ESU (Room 101) in the George Edgecomb Courthouse at 800 East Twiggs Street or by US mail to P.O. Box 1110, Tampa, FL 33601-1110.  

A copy of your Petition must also be delivered to the Office of the State Attorney and the arresting agency.
